Terms and Conditions - OROLOGI che PASSIONE

These terms and conditions govern the contracts of sale between the purchaser (here in after referred to as the “Purchaser”) and Orologi che Passione, Via Conte Ruggero snc., 93014 - Mussomeli (CL), Italy, Tax Number 01910290855 (here in after referred to as the "Seller”).

1. General Selling Conditions

The general selling conditions here in govern all the contracts of sale entered into between the Purchaser and the Seller through the web site www.orologichepassione.it. Each contract is subject to the general selling conditions published on the web site at the time when the contract is stipulated.
Any change proposed by the Purchaser shall not modify the general selling conditions, unless explicitly accepted in writing by the Seller. 

2. Contract Parties

The on-line shop on the www.orologichepassione.it web site is intended for the exclusive use of the consumers, i.e. it is reserved to retail.

3. Contract Execution

The offers on www.orologichepassione.it are not binding for the Seller and do not represent an offer to the public.  The Purchase Order of the Purchaser is a binding contractual proposal.  The Purchase Order is accepted by the Seller by way of an e-mailed Order Receipt, containing an extract of the selling conditions (product description, price, payment terms). 
In case the Purchaser does not receive the Order Receipt, or another similar communication, from the Seller after placing the Order, the Purchaser shall promptly contact the Seller through its address: watchinpassion@gmail.com

Some products offered on the Site may be limited in number. It may happen, also because of the possibility that multiple users at the same time acquire the same product, that the product ordered is no longer available after the transmission of the purchase order. In any case of unavailability of the product ordered, the customer will be promptly notified by email and the purchase order will be canceled. If payment has already been executed, Orologi che Passione will refund the total amount paid by the client - the purchase price, the cost of shipment and any other additional cost - immediately, and in any case within than thirty days from the day after the order. The refund amount will be notified via e-mail and credited to the same payment method used by you for the purchase.

4. Prices and Freight Charges

The price of products is shown on the price list published on the web site the day of the order issue and before the purchase order is issued. The total end price of the purchase order includes freight charges, but it does not include any custom duties and/or additional sales taxes, required for importing the merchandise into a foreign country. Any additional charge for custom clearance operations shall be exclusively charged to the customer. 

Delivery times are indicated on the product page. In the case of an order with multiple items, we inform you that any product will be handled individually, so it will be very likely that they will have different delivery times. All prices are in Euro and are VAT included.

5. Payments

The payment shall take place in one of the two following ways :
- PayPal: directly from the Purchaser PayPal account or by credit card. In case of payment by credit card, the credit card details are forwarded to PayPal, which shall carry out the payments on behalf of the Seller.
- Advanced bank transfer : payment can be performed through advanced payment at our bank account that you will be notified.
The credit card data forwarded during order execution are protected against the non-authorized access by means of encrypted data transfer.

6. Guarantee

6.1 Legal Seller’s Guarantee.
The Seller grants a legal guarantee on the product by virtue of the 44/99/EC-Directive, for cases of product non-compliance to qualities defined in the selling contract, as set forth by the applicable regulations in force. The guarantee allows the Purchaser, in case of product compliance failure, to contact the Seller directly, within 15 days , and ask for the product change or the contract resolution. However, the Purchaser is in no case granted a guarantee coverage for improper use of the product, non-compliant with its proper use as defined by the Seller/Manufacturer (instructions for use printed on the product itself). Any complaint shall be accompanied by a document giving evidence of the purchase (fiscal document issued by the Seller/payment receipt).

6.2 Complaint requirements

The complaint shall be made by the Purchaser promptly and not beyond 15 days from the date when the Purchaser found the non-compliance defect. During this time period, the product cannot be used.  The Complaint shall be forwarded by telecommunication means to the Seller, who shall immediately advise the Purchaser about the procedure for product return.

7. Right of Withdrawal

The customer who bought products through the Site has the right to terminate its contract with Orologi che Passione, without any penalty and without specifying the reason, within ten (10) working days from the date of receipt of goods. However, for our internal policies and manufacturers, it is possible that some items can not be such a service for various reasons (customization, luxury goods with high costs, limited editions etc..). In this case, the user will be notified prior to purchase by means of a notice on the page of the product. The order of the product is to be understood as tacit acceptance of this condition is not made. Will still be applied to the general warranty provided for all items. "
To exercise the right of withdrawal, the user must:
send an email with a request for withdrawal at watchinpassion@gmail.com, where you must also give the bank needed to repay the sums paid; confirm, within forty-eight hours (48) after the notice of withdrawal by means of registered letter with acknowledgment of receipt to the address indicated. The letter is considered sent in due time, if delivered to the post office within the period specified above;
provide, using a carrier of their choice at their own expense, within ten working days from the date of receipt of goods, the shipping of / the product / s purchased / i, suitably protected / packed ie / s in its original packaging, together with / from the Any accessories. Pursuant to art. 67, paragraph II of the Consumer Code, is an essential condition for the exercise of the right to withdraw the 'integrity of the product to be returned. The products, therefore, must not have been damaged or altered.
In accordance with art. 67, fourth paragraph of the Consumer Code, only after receiving the / these product / ie only after verifying a positive compliance with the terms and modalities for exercising the right of withdrawal as well as the integrity of the products, Orologi che Passione that will, in the shortest time possible, and in any event within thirty days from the date on which Orologi che Passione became aware of the right of withdrawal, to reimburse the sums paid by the user. 8. Venue and Applicable Law

Any dispute related to the implementation, execution, interpretation and breach of this contract shall be settled according to the Italian law.  Any dispute between the parties related to this contract shall be settled by the Court of Caltanissetta, unless different regulations on behalf of the Purchaser are proved applicable.

9. Language

The present selling conditions are drawn up in two languages: Italian and English. In case of translation non-compliance, the Italian language shall prevail.

10. Privacy

Data made available by the Customer and required for contract execution are handled in compliance with the Leg. Decree 2003 No.196  concerning the “Personal data protection”. For any other information, please refer to the “Privacy” section on the web site www.orologichepassione.it
